By accessing or using the Yallah Morocco website and booking platform (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use our Platform. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Yallah Morocco ("we," "us," or "our"), a tour operator based in Agadir, Morocco.

Yallah Morocco operates a tour booking platform that facilitates the reservation of tours, activities, surf lessons, cultural experiences, airport transfers, and related services in the Agadir and Taghazout regions of Morocco. Our Platform allows users to browse available services, view pricing and availability, submit booking requests, and manage their reservations.

We act as the direct provider of the services listed on our Platform. All tours and activities are organized and delivered by Yallah Morocco and our network of trained local guides and partners.

Submitting a booking request through our Platform does not constitute a confirmed reservation. The booking process follows these steps:

1. Booking Request: You select your desired service, date, number of participants, and provide your contact information.
2. Email Verification: You verify your email address to confirm the legitimacy of the booking request.
3. Staff Review: Our team reviews your request to confirm availability, guide allocation, and logistics.
4. Confirmation: You receive a confirmation email with full booking details, meeting point information, and any relevant instructions.

A booking is only considered confirmed once you have received a written confirmation email from our team. We reserve the right to decline any booking request at our discretion.

All prices displayed on our Platform are in Moroccan Dirhams (MAD) unless otherwise stated. Payment is collected in cash upon arrival at the meeting point on the day of your scheduled activity. We do not require advance online payment for standard bookings.

By confirming a booking, you agree to pay the full stated amount at the time of service. Failure to pay the full amount may result in the cancellation of your activity and forfeiture of future booking privileges.

We understand that plans can change. Our cancellation policy is as follows:

• More than 24 hours before the scheduled activity: You may cancel free of charge. A full refund or booking credit will be provided if any advance payment was made.
• Within 24 hours of the scheduled activity: No refund will be provided. The full booking amount remains due.
• No-show: If you fail to appear at the designated meeting point at the scheduled time without prior cancellation, no refund will be issued.

Cancellations can be made by contacting us at hello@yallahmorocco.com or through your booking management page on the Platform.

Certain activities, particularly surf lessons and outdoor tours, are subject to weather conditions. If we determine that conditions are unsafe or unsuitable for an activity, we will offer you the choice of rescheduling to an alternative date or receiving a full refund. Weather-related cancellations initiated by Yallah Morocco are always fully refundable.

When using our Platform and participating in our services, you agree to:

• Provide accurate and complete information when making bookings.
• Arrive at the meeting point on time as specified in your confirmation.
• Follow all safety instructions provided by our guides and staff during activities.
• Disclose any relevant medical conditions or physical limitations that may affect your participation.
• Treat our staff, guides, other participants, and local communities with respect.
• Not engage in any activity that is illegal under Moroccan law or the laws of your home country.

Yallah Morocco takes all reasonable measures to ensure the safety and quality of our services. However, participation in outdoor activities, adventure sports, and travel inherently involves risk. To the maximum extent permitted by law:

• We are not liable for any injury, loss, or damage arising from your participation in activities, except where caused by our proven negligence.
• We are not responsible for loss or theft of personal belongings during activities.
• Our total liability for any claim arising from our services shall not exceed the amount you paid for the specific service in question.
• We strongly recommend that all participants obtain comprehensive travel insurance that covers adventure activities.

All content on our Platform, including but not limited to text, images, photographs, logos, graphics, videos, and software, is the property of Yallah Morocco or our licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our Platform without our prior written consent.

By submitting reviews, photos, or other content to our Platform, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content in connection with our services and marketing.

Your use of our Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our Platform, you consent to the practices described in our Privacy Policy.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our Platform. The "Last updated" date at the top of these Terms indicates the most recent revision. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.

For material changes that significantly affect your rights, we will make reasonable efforts to notify you via email or a prominent notice on our Platform.

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco. Any disputes arising from or related to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Agadir, Morocco.
